FACE PAINTING AGREEMENT - TERMS AND CONDITIONS
IMPORTANT LIABILITY STATEMENT: I am fully insured and I only use FDA approved cosmetic-grade make-up, glitter and glue at all times. The Artist is not responsible for any allergic reactions. By making a deposit to hold your party, you accept this agreement and will NOT hold the Artist liable for any allergic reactions. Children with skin allergies or sensitive skin should either not participate, have an arm or hand painted, or have the Artist perform a 'patch test' at the beginning of the party. Even baby wipes, as gentle as they are, can be an irritant to some sensitive skins. For safety reasons, the Artist will require children under 2 years old to be held by a parent or guardian during painting. The Artist assumes the right to cease painting on a child should a child be crying or is showing obvious signs of fear or frustration. For sanitary reasons, the Artist will not paint anyone who is or appears to be sick or suffering from: cold sores; conjunctivitis; any infectious skin condition; eczema, lice, or open wounds. The Artist will at all times use reasonable care, but is not responsible for damage to clothing or property. The Artist will not supervise children. Their behavior and safety is the Client’s and/or Guardian’s responsibility.
**I only use FDA compliant paints, the highest quality face paints and cosmetic glitters out there used by world renowned face painters, some of which paints have been around for decades. They all wash off with ease using a warm washcloth, soap and water. However, please do keep in mind that with all cosmetics, reactions can occur. Should your child have sensitive skin, you may not want to have his or her face painted just to be on the safe side. Even baby wipes, as gentle as they are, can be an irritant to some sensitive skins. I am not liable for any reactions that these paints may cause.**

Mileage Fee of $.57 per mile may be included for areas more than 20 miles away from Coopersburg, PA, Zip Code 18036.
Booking Fee: A Booking Fee of $25.00 must be paid in advance in order to guarantee the date and time of your event. I collect this booking fee because I am now holding your event for that date and time, which now prohibits me from booking another party. Another event may be scheduled for the desired date and time if the booking fee is not received. An e-mail will be sent when the date has been confirmed. This fee goes towards the event and will be deducted from your balance. It is non-refundable should you cancel within 14 days of your event. However, if you decide to reschedule, then this fee will go towards your rescheduled event.
Payment Terms: The balance agreed to in the contract, plus mileage fees/tent fee (if applicable), etc., is due on the day of your event. Balance payment will be accepted by way of cash, check or credit (3% will be appliedfor credit card charges). The Client will reimburse the artist for any parking fees that may be accrued. Should you choose to have me stay longer than the original time allotted, we can discuss the details then.
Returned Checks: There will be $30.00 fee for returned checks, plus the amount of the check. If paying your deposit by check, your date is not considered held until the check has cleared through the bank.
Cancellations: Should you need to reschedule the event, please do so at least 14 days prior to the date of the event. Every effort will be made to meet the Client's needs. If the event must be cancelled, the booking fee is only refundable if requested at least 14 days prior to the event. Should the Artist(s) become unavailable due to illness or emergency, the artist will make every effort to have another painter, with the same quality and standards, fill her spot if that is acceptable with the client or the deposit will be completely refunded.
Location: A minimum of 6’W x 6’L of level space, with protection from extreme temperatures, sun, rain, snow and excessive wind is required. Also required is adequate lighting, access to a rest room and a place to dispose of water. A table, chair, and all face painting supplies are provided by the Artist.
Outdoor Setup: **Outdoor Setup Only Available from May thru October** (Option #1) Sun/wind/rain shelter, space, and lighting is provided. (Option #2) A 10’ x 10’ shade canopy is provided by the artist for an additional fee of $25.00. Approximately 30 minutes to set up/take down and a little help is sometimesrequired. If bad weather or wind of over 20 mph are forecasted, the canopy cannot be used.
Limitations On Artwork: The Artist will not paint on any part of the body that is not legal to expose, or any place he/she does not feel comfortable painting. The Artist will not paint any design or wording that could be considered obscene, offensive, violent to the Artist, or defies good taste. The theme and art desired should be established before the Artist arrives at the event.
Adverse or Unsafe Working Conditions: The Artist has the right to cease painting and leave without refunding any monies if there are adverse or unsafe working conditions and the Client fails to remedy the situation after it has been brought to the Client’s attention. Adverse or unsafe conditions include, but are not limited to: bad lighting, destructive, violent, or extreme inappropriate behavior of a child, pet, or adult, illegal activities,or otherwise dangerous weather conditions.
